1. Acceptance of Terms
By accessing or using MyNotifyAssist ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
MyNotifyAssist provides a platform to schedule and send notifications via SMS, WhatsApp, email, and voice call. The Service includes a calendar view of scheduled notifications, plan upgrades and payment, service requests and quote requests, connections for managing recipients, and account settings. Optional HR and Clinic business profiles may add module-specific features after admin approval.
2a. Notification Delivery (Failures and Delays)
Delivery is best-effort. We do not guarantee that every scheduled notification (SMS, WhatsApp, email, voice call, or push) will be delivered or delivered on time. Messages may fail or be delayed due to third-party delivery providers, carriers, invalid destinations, policy or template rejections, Do-Not-Disturb (DND) or regulatory blocks, geographic or sender restrictions, outages, or network conditions.
SMS in particular is not guaranteed. SMS depends on mobile carriers, national regulations, and our messaging providers. In India, messages must comply with DLT registration and approved templates; TRAI promotional timing rules may block or delay messages outside permitted hours unless you have accepted our TRAI policy. International SMS may use different sender types with country-specific limits. A message shown as sent from our platform does not mean it was received on the device.
We are not liable for missed or delayed notifications. For critical reminders, use multiple channels (push, email, SMS) and do not rely solely on the Service. See also section 5c.
3. Account and Registration
You must provide accurate information when registering. You are responsible for maintaining the security of your account and for all activity under it. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
3a. Business Profiles (Essential, HR, and Clinic)
You may apply for an optional business profile for HR or Clinic use cases. We may approve or decline at our discretion and may revoke a business profile for operational or compliance reasons. You are responsible for lawful use of the Service and applicable regulations.
4. Acceptable Use
You agree not to:
- Use the Service for illegal purposes or to send spam, fraud, harassing, abusive, or prohibited content.
- Violate any applicable laws or third-party rights.
- Attempt to gain unauthorized access to the Service or other accounts.
- Resell or redistribute the Service without our written permission.
- Use the Service in a way that could harm, overload, or impair our systems.
4b. Notes and public sharing
Private notes are not indexed by search engines. Public read-only links let anyone with the URL view a note until expiry or revocation. Public read-only link pages (/public/note/…) are not indexed by search engines. Links expire after 7 days and are removed. You must not share illegal, abusive, sexual, or misleading content; web links, phishing, or malware are blocked. Comments on public links (when enabled) require a signed-in account. We may revoke links, remove comments, or suspend accounts for abuse.
4a. Invitations and referrals
If you use invitations/referrals, you agree to use them lawfully and not to spam. Referral bonuses and promotional rewards may vary by plan and configuration and can change over time.
5. Payment and Plans
Paid plans are billed according to the pricing shown at the time of purchase. Plan details and limits are displayed in the app/website. Where applicable, refunds are governed by our Refund Policy.
Subscription and billing by platform
MyNotifyAssist offers paid access through different billing systems depending on where you upgrade. The price, currency, and duration are shown on the checkout/paywall screen before you confirm payment.
- Website purchases (Razorpay): Website upgrades are processed via Razorpay. Website plans are typically time-limited (prepaid) for the period shown (for example 30/90/365 days) and do not auto-renew unless we explicitly disclose a recurring option. When the period ends, your account returns to the default free plan unless you upgrade again. Refund handling for website payments is in the Refund Policy.
- iOS in-app subscriptions (Apple App Store): Billing is handled by Apple and may use an auto-renewable subscription. The subscription renews until you cancel in Apple subscription settings (see Manage subscriptions). We do not process App Store payments or refunds directly.
- Android in-app subscriptions (Google Play): Billing is handled by Google Play and may use an auto-renewable subscription. The subscription renews until you cancel in Google Play subscription settings (see Manage subscriptions). We do not process Google Play payments or refunds directly.
Cancellation: If you cancel an auto-renewable subscription, access usually continues until the end of the current billing period (store rules apply). For website purchases, you can stop using the Service at any time; the plan remains active until its expiry date.
5a. Government and Legal
You are responsible for complying with laws in your jurisdiction. For India, communication timing policies (TRAI) apply to certain channels. See Communication Timing Policy (TRAI).
5c. SMS Messaging Terms
When you provide your mobile number and opt in via our website (optional checkbox at registration or when verifying your number in Account Settings), you consent to receive SMS messages from MyNotifyAssist, including one-time verification codes and service notifications such as reminders and alerts you schedule.
- Message frequency: varies based on the reminders and notifications you schedule and any verification codes we send.
- Message and data rates may apply. Check with your carrier.
- Delivery not guaranteed: SMS may fail or be delayed due to carriers, DLT/template rejection, TRAI timing or DND rules, invalid numbers, international sender restrictions, or provider outages. We do not guarantee that any SMS will reach your device. See section 2a.
- To opt out: reply STOP to any SMS from MyNotifyAssist. You will receive one confirmation message. You can also update SMS preferences in Account Settings → Privacy.
- For help: reply HELP or email support@mynotifyassist.com.
- Consent is not required to create an account or use the Service. SMS opt-in is separate from accepting these Terms or our Privacy Policy.
Recommended for important reminders: select more than one notification channel (e.g. push and email in addition to SMS) so a single carrier or policy failure does not leave you without notice.
This SMS programme is operated by MyNotifyAssist. Your phone number is shared with our SMS delivery providers (e.g. Twilio or other carriers we configure) solely to deliver messages you have requested. We do not sell or share your number with third parties for their marketing purposes.
6. Intellectual Property
The Service (excluding user content) is owned by us. You may not copy, modify, or create derivative works without permission.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation or guaranteed delivery of notifications.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the Service or violation of these Terms.
10. Termination
You may close your account at any time via the account menu. We may suspend or terminate accounts for breach, abuse, or other reasons with notice where practicable.
11. Changes to Terms
We may update these Terms from time to time. Continued use after changes constitutes acceptance.
